The following letter was forwarded to Senator Ted Kennedy's Office after a number of materials and correspondence were previously provided to public official and local authorities. Neither Senator O'Leary nor Senator Kennedy acknowledged the correspondence, but there is suddenly and effort on to provide necessary services to this population.

Dear Senator Kennedy

Homeless people in Hyannis and greater Barnstable County applaud the relief effort and two million dollars in funding negotiated via Phil Mangano and extend their sincerest gratitude. We are particularly thankful considering the current financial and socio-economic instability we all face in uncertain times. Unfortunately, the generosity of the people of Barnstable was exploited by a number of human service agencies operating at a negligent standard. As you are aware, I have forwarded extensive materials to public officials including Senator Robert O’Leary, Representative Demetrius Atsalis, District Attorney Michael O’Keefe and President Janet Swain Joakim in regard to the compromise of safety of children in Hyannis and Greater Barnstable. I have spoken many times before The Barnstable Town Council in regard to improvement of the standard for safety for all, especially children. Please note the compromise to safety of children living in the Marstons Mills Village of Barnstable. I have enclosed the court documentation and correspondence forwarded to the town attorney’s office in regard to the actions of sitting town council President Janet Swain Joakim.

President Joakim provoked and antagonized a tenuous situation involving families and children in a neighborhood of an adjacent precinct. Janet Joakim engaged in malicious and malevolent “blogging wars” by posting libelous materials on her personal website. Much of the postings and comments inflicted substantial emotional distress on many residents of Barnstable. Victims of President Janet Swain Joakim’s reckless behavior remain greatly concerned of the impact of this behavior on children. Not only did President Joakim endanger the health, welfare, and safety of innocent children by maligning adversaries via the Internet, President Joakim advertises her website from the town council bench. Joakim directed me to be forcibly removed from the town council podium for ardent criticism of outrageous behavior and impropriety. Please consider the enclosed computer disc with vitriolic and malicious notation posted and a video produced from town meetings.

Demetrius Atsalis and Janet Joakim leaned on local law enforcement to charge the individuals that she intentionally provoked. The charge was deliberately timed to coincide with a special recall election as provided by the town charter to remove Janet Joakim from office. Please note the photographs provided of Chief Paul MacDonald assisting Janet Joakim as she campaigned to keep her council seat.

Lastly, I have included a number of photographs of conditions in downtown Hyannis in campsites. Some of these photographs have been taken in front of the Kennedy Museum and behind the National Armory where your brother John first announced his intent to run for President. President Janet Swain Joakim is not only a municipal leader; she is also your sitting town council president. President Joakim ignored the conditions of this substandard and negligent agency. Complaints regarding the compromise in safety to all members of the community were brought before the town council on a number of occasions. The policies of President Joakim continue to jeopardize the health, welfare and safety of children in the Town of Barnstable. I am asking for your assistance to insure the immediate removal and dismissal of President Janet Swain Joakim from elected office. Her actions are not consistent with the spirit of the Democratic Party and the principles that you have fought for and in which we all believe.

Dear Senator O’Leary,

We missed your commanding presence at the Airport Commission Meeting of November 18th. I presented statistics on criminal behavior among the NOAH/PILOT population as quoted in a casual conversation by Bob Lynch the employment specialist. Mr. Presbrey refuted these statistics in particular the 25% Mr. Lynch stated have been incarcerated for sex offenses against children. I enclose a letter to Mr. Presbrey where where I have listed four pedophiles that harassed me at NOAH. The names provided already account for 11% of pedophiles and extremely dangerous criminal offenders. Obviously, I had no knowledge of the backgrounds of these individuals when they asked me for rides and money when I met them. I had been told by Paulette Health and other staff at NOAH that I should be more sensitive and tolerant of the criminal element and I was trying to provide services to these individuals and did so at my own risk. Henceforth I never had a comprehensive or complete list of serious offenders and I can reassure you that the names provided are only a minor fraction of individuals that I am aware have lesser offenses and have been incarcerated at facilities such as Cedar Junction and Framingham. Mr. Presbrey called my recitation of Mr. Lynch’s statistics irresponsible.

Mr. Lynch now states that he has no recollection of such conversation and has no specific nor exact knowledge of the population of criminal offenders or demographics in regard to such.. Mr. Lynch states that Judy Best called his wife Gisele from her cellular phone on the way home from the meeting to inform her of the events that transpired concerning her husband. Gisele Lynch is her Administrative Assistant at the Duffy Clinic. The Duffy Clinic is a spin off organization which was intitially provided with its economic funding from Housing Assistance Corporation. Please see the tax returns for all agencies provided on public record to the Airport Commission. For the benefit of all NOAH staff I have terminated all friendships regarding potential controversy per impending litigation.

Please forgive my tremendous sense of irresponsibility when demonstrating concern that innocent parties may suffer the way I did because of the gross negligence of the shelter. I am working as hard as I can to understand and tolerate the perspective you espouse for your constituency. It’s difficult for me to realize the inportance of protecting the human service industry at the expense of innocent children and others. I respect your right to differ in opinion and policy despite the threat to public health and safety. I realize the value of special interests to your political party, but it’s unconscionable to promote an industry that is ineffective at rehabilitation leaving society’s most vulnerable at risk.

Please review a sampling of the letters that are in the hands of my attorney and local officials. Please also review a number of official documents in regard to HAC/NOAH/Duffy suggesting that the majority of NOAH clients are either currently rehabilitated or not a general threat to the community. I have also enclosed a photograph of narcotics offenders freebasing in my backyard. Two of these offending individuals have indeed served jail time and all three have been in treatment for their offenses on numerous occasions. Out of deference to Mr. Presbrey I will admit that these three individuals all known to the Hyannis area for drug trafficking are indeed criminals with lesser violent offenses that many of the NOAH clients I encountered in my sojourn at and among NOAH.

I have noted that according to the Cape Cod Economic Development Commission, 60% of Cape Codders rank the area as their chosen residence because of Safety Issues. I recall the overwhelming mandate of November 5 against a Proposition 21/2 Override.
I appreciate your insistence on representing all citizens especially the disinfranchised. I am unsure that pyromaniacs, pedophiles and recidivist narcotics offenders deserve the same consideration and deference at the expense of the innocent. Nevertheless, I respect your right to lobby for their interests. I will be throwing my support next year to a more conservative candidate who represents the old fashioned homespun value of commonsense and I will be encouraging others to do the same.

Best wishes in your re-election bid and for your unwavering commitment to the sovereign rights of the criminal element.
