Where, or Where Did My Witness List Go...

Note the extensive list of witnesses proposed by J. Drew Segadelli, Esq. for the defense of Mrs. Taryn A. Thoman of Marstons Mills in the Case of The People v. Thoman. Taryn Thoman suggested that a number of individuals, some with illustrious careers in Barnstable would be ready, willing and credible parties to testify to allegations of abuse and neglect of families at Mountain Ash Road. Thoman's attorney intended to accuse Ms. Christine Howell and Ron Howell of 10 Mountain Ash Road, Marstons Mills that their efforts to protect their children from specious accusations and unfounded allegations were strictly political.

Mrs. Howell became involved with Political Action Committees formed to evaluate organizations and agencies delivering services within The Town of Barnstable. These associations included work with the school committee and lobby groups to promote child health and welfare. Ms. Howell is a reputable and exemplary nurse with a stellar Grade Point Average from Cape Cod Community College. As we have stated previously, this small, local, but outstanding institution of higher learning has reputable programs, not just in nursing, but clearly in computer in informations system technology. The ability of professors and adjunct personnel, including student employees to instruct in practice disciplines is outstanding.

The case against Thoman was so tenuous that all of the intended witnesses declined to be present and available for testimony. Thoman's attorney, J. Drew Segadelli, Esq. concedes that there may indeed have been substantial conflict of interest in his representation of Thoman. Judge William O'Neill was also not pleased to discover that Taryn Thoman was harassing a number of law enforcement agents and public officials via the Internet. My understanding is that he is less than thrilled with Thoman's endorsement on previous postings available on www.barnstable411.com. Ms. Thoman implies that Judge O'Neill is ruling evidence as admissable based on corruption of law enforcement agents. Judge H.Gregory Williams did suggest that some of the jurists feel threatened in some way by the atmosphere created by members of Citizens for Open Government.



Note the docket number and items of criminal harassment charged upon Ms. Taryn Thoman of Marstons Mills. Thoman was not only accused of falsifying police reports and making vindictive and malicious DSS Reports against an innocent family and neighborhood of children. Taryn Thoman and her husband Dennis Wilcox stalked Ron Howell's work and attempted to write anonymous letters to the employers of this hard working couple. As it stands right now, neither Thoman nor Wilcox are gainfully employed. Although Wilcox claims to have a small business as a private contractor, he usually found at home and intoxicated during the day. Taryn Thoman attends a number of boards and committees, unable to regain stability, she blogs every day, all day.

Taryn Thoman claimed on a number of websites and blogroll comments that it was the "her" decision to refrain from taking the witness stand. Thoman suggested that the prosecution was simply unable to make its case. Ms. Thoman actually believes it was her choice to refuse to assume the witness stand. Competent Defense Attorneys refrain from placing guilty defendants on the stand, at all costs. Segadelli orignally intended to put Thoman on the witness stand. Drew Segadelli changed his mind after witnessing the quality of the prosecution and preparation of witness for The People. Thoman also states emphatically that it was her decision to ask for a bench trial rather than a jury trial. Witnesses in the court room heard Defense Counsel J. Drew Segadelli, Esq. insist on a jury trial. The presiding judge suggested to Segadelli that it was unwise to "even want to speak to Chief Justice O'Neill, considering..."

Clearly indicated in the record posted above is the Defense Counsels intent to have Taryn Thoman tried before a jury. Not only did her attorney petition for such a trial, but postponed the date because the discovery was not complete. Clearly, you can read that Thoman's attorney assented to a "trial by jury". On May 14, 2009, Segadelli's mind was changed for him by Judge William O'Neill. Taryn Thoman posts that Judge William O'Neill is her "hero" on www.barnstable411.com. Thoman's blogroll was developed to harass the witnesses for the prosecution and law enforcement agents prior to the onset of the hearing. Obviously, Thoman is unable to assist with counsel and demonstrates grievous lack of judgement. Drew Segadelli lost his temper several times in the court room and appeared to be "unconfortable" and intimidated.

Here were the items considered of concern to Clerk Robert Powers:

I called this matter a little after 4pm, no Atty had appeared. I informed Ms. THOMAN that the hearing would proceed with or without counsel-she indicated that Mr. Segadelli had some matters in other courts as well. The hearing began as the courtroom was cleared. All witnesses were sequestered. Sgt. Caido gave a brief overview of the case. A.D.A.E. Connor was also present. A full, complete and extensive hearing was held. Sometime during the hearing the A.D.A. received a call from Mr. Segadelli saying that he would not be coming. He said he had been in his office all afternoon and that although he had spoken to the defendant earlier in the day, he had not been retained.

Christine Howell was the first to testify and gave extensive testimony of various events from August 2008. She gave testimony of various events from August 2005 up till August 2008. She gave testimony about her experiences as well as her husband’s.

Officer Mark Delaney was next to testify. He talked about how he first got involved with the parties (neighbors) back in 2006. He also gave testimony about events he was involved in with the parties.

Based on his testimony and that of Ms. Howell I did not hear from Mr. Howell, believing that his testimony would be duplicitous at this point.

I then allowed Ms. THOMAN to present witnesses. Her first witness was her husband D. Wilcox. He was followed by his old boss, R. HAYES. Mr. Hayes had no direct knowledge of any of the issues before the court. Mr. LOPEZ was her final witness. He also didn’t have much to add other than he believed Ms. THOMAN was responsible for putting a video of Ms. Howell on U-Tube.

Ms.THOMAN was then given the opportunity to speak. At some point during the hearing, I did ask Ms. THOMAN if she was O.K. She said she was, although she would waive a large baggie full of apparent prescriptions in the air every once in a while. In a prior motion she had put forth

that she had immediate medical issues. I asked her several times about them and any doctor’s letters she might have, but she failed to produce anything.

I also asked her if she was on any medication today which would cloud her thinking. She said “no!” I asked her if she was under the influence of alcohol or illegal drugs today and she said “No!”

I believe that Ms. THOMAN was a competent witness and I allowed her to continue her testimony.

At the conclusion of all the testimony, about 21/2 hours after it began I was given some additional papers from both Ms. THOMAN and Ms. Howell.

I took all the paperwork and my copius notes along with the file. This matter is “Under Advisement.”

Taryn Thoman continues with Internet Harassment against the Howell family despite her occasional "Luck of the Irish" in the Barnstable District Court. Thoman has yet to realize the political price of "Kissing the Blarney Stone".

Please consider running against Janice Barton for the precinct 10 council seat. I personally think you would a good addition to the town council and bring a new and fresh perspective to local politics.

There are a few perks to consider in running for the seat on the council.

1. Janice Barton will have to actually fight for seat for once!
2. You have proven you can get a good number of votes.
3. Your son will be proud of you
4. The idea of you possibly being on the council will drive Janet Joakim out of her mind.

Just think of the number of sleepless nights Joakim will endure between now and November wondering about the outcome the election. It might just distract her enough to allow someone to take the Precinct 6 seat out from under her.
