So Just How Convoluted Is The Corruption, Anyway?

Review the correspondence forwarded to Barnstable Town Attorney Ruth Weil, Esq. Ms. Weil is the next door neighbor to Sergeant Sean E. Sweeney and his wife, Jane. Jane Sweeney threatened me at Cape Cod Hospital in the Emergency Room. I complained about the incident and forwarded a formal complaint on her nursing license in 2007. I had been arrested for "criminal harassment" of the Sweeney family. Chief Paul MacDonald forwarded documentation claiming that I was "mentally ill" and lying about the incident. The investigation was called off after Chief MacDonald discredited me.

It turned out that a witness with a medical record proved that Jane Sweeney was indeed at the hospital on the night in question. She overheard Ms. Sweeney complaining to another nurse about "the homewrecker". She also heard Ms. Sweeney state that she waited at the Emergency Room entrance for five hours to confront me. This was also my recollection of the night I was terrorized by Jane Sweeney.

Dear Ms. Weil,

Please consider the enclosed correspondence forwarded to a number of public officials and attorneys with interests in public safety in Hyannis and Greater Barnstable. There appears to be a pattern of ongoing impropriety convoluted with the quality of human services and law enforcement in Barnstable County. Unfortunately, the problem now involves Cape Cod Hospital and related personnel. On December 2, 2009, I was arrested by the Barnstable Police Department and charged with Disorderly Conduct, Resisting Arrest and Criminal Harassment. Unfortunately, I was agitated, irritated and extremely perturbed after locating a witness to the assault, attack and threat on my life made by your neighbor, Mrs. John E. Sweeney. Jane Sweeney did, indeed, attack me at Cape Cod Hospital on the evening of December 19, 2004, precisely as I had claimed. The assault occurred in the Emergency Room, outside of my assigned room in the ER, and then again in proximity to the ambulance entrance. Mrs. Sweeney was told to move away from me by my attending nurse, Katie Teravainen RN. Jane Sweeney waited for me by the ambulance entrance. I now have discovered records of this altercation and a witness who indicates she was a patient of Jane Sweeney on the Telemetry Unit. Sweeney is employed by this unit and patient records indicate that she was working on the evening in question.

Another witness has emerged that states that Mrs. Sweeney started a respiratory treatment on her in the late evening of December 19th. Sweeney did not return to remove the empty canister of Albuterol. Jane Sweeney, RN, left her patient in the care of a Nurse’s Aide. The patient/witness claims that the Nurse’s Aide had to remove the Albuterol Respiratory Treatment hours after the canister had run dry and the medication emptied. The patient then overheard Mrs. Sweeney telling one of her fellow nurses and colleagues that she went down to the Emergency Room to tell off the “little home wrecker”. The patient of Mrs. Sweeney has medical records in her possession confirming that Sweeney was employed and giving care to patients on the evening in question. You may be aware that Jane Sweeney, her colleagues in the Emergency Room, Chief Paul MacDonald and Sean Sweeney of the Barnstable Police Department have emphatically denied the incident.

On December 2nd of 2009, I complained once again to the Barnstable Police Department about the attack and threats made by Jane Sweeney, RN. I told them a new witness had come forward. I complained again to Officer Christopher Challies that Jane Sweeney assaulted me. Patrolman Christopher Challies began following me around Hyannis. Challies was screaming from his car that the “Sweeney’s had a “restraining order” against me. He yelled from his car that I was under arrest. Challies pulled his police cruiser over on Main Street and chased after me on foot. He caught hold of my shoulder and threw me onto the pavement on Main Street. Challies produced severe bruising and lacerations covering the entire front of my person. When I struggled to keep my jogging/sweatpants from being caught in the handcuffs, Officer Challies and Detective Mark Delaney cited me for “Resisting Arrest”. Challis then grabbed the waistband of my sweatpants and pulled them down to my knees. I was completely exposed on Main Street while the officers laughed as I lay facedown on Main Street. The incident occurred in the morning hours, in broad daylight, with many witnesses passing by, and in full view of several store owners.

As you know, I complained to former Assistant Town Manager, Paul Niedzwiecki that Interim Police Chief Paul MacDonald was not prepared for the position that he now, permanently, holds. I have been once again charged with Criminal Harassment. The Barnstable Police Department has charged me despite compelling evidence that your neighbor, Jane Sweeney, RN, assaulted, threatened and attacked me, precisely as I claimed. You may also be aware that credible witnesses, including Assistant District Attorney Eileen Connors and Detective Jason Laber have given statements in regard to the behavior of Detective Valerie Hemmila at my home in 2004. Both have given statements describing Hemmila’s attempt to “cut off the hair” and “rape the defendant”. The items are saved on tape. Valerie Hemmila and Head of Detectives, David Cameron interviewed be on September 20th, 2004. The interview ended with Hemmila threatening me. Detective David Cameron was subsequently demoted. Your predecessor, Barnstable Town Attorney Bob Smith spoke to me about this event. The late, Mr. Smith, stated verbatim, “Town of Barnstable owes you a lot of money, young lady”.

My defense attorney, Robert Laliberte, Esq. insisted that I wait until the complaint and charge of Criminal Harassment was disposed of before I complained in any way about the actions of Mrs. Jane Condinho Sweeney. I was unable to complain to authorities until 2007. Meanwhile, Chief John Finnegan was dismissed and Paul MacDonald hired as an Interim Police Chief. After the charges were dropped in 2007, and a new Police Chief had been hired and I filed complaint on the license of Jane Sweeney, RN. Chief Paul MacDonald wrote to the Board of Registration in Nursing. MacDonald circumvented my complaint on the nursing license of Jane Sweeney. In the document forwarded to the Board of Registration in Nursing, Chief MacDonald dismissed my recollection and account of the assault, attack and threats made by Mrs. Sweeney on December 19, 2004. He told the Board of Registration in Nursing that I am “mentally ill” with “no credibility”. I am in possession of the affidavit forwarded to the Board of Registration in Nursing prepared and forwarded by Chief Paul MacDonald on behalf of Mrs. John E. Sweeney. Since the incident and charges against me, two more witnesses have come forward claiming that Jane Condinho Sweeney frequents the Emergency Room. As I stated previously, one witness places her working on her unit at Cape Cod Hospital on the evening in question. This witness has records indicating that Sweeney was, indeed, working that evening. Both Paul MacDonald and Sean Sweeney denied that Mrs. Sweeney was working on the evening of December 19, 2004. The hospital also forwarded records that gave the appearance that Sweeney was not in their employ on that evening. Patient records indicate otherwise.

If you didn’t think that I had meritorious litigation against the Town of Barnstable before, considering what has transpired, maybe you do now. Feel free to discuss the charges with my defense attorney, Penelope Psomos at (508) 362-0166.

Thank you for your time and attention.

Yours truly,

Mary Clements
